A number of senior NZISM members/supporters were closely involved in the legal proceedings that resulted from the tragic Whakaari eruption that killed 22 people and injured a further 25, in December 2019. Now the proceedings have drawn to a close, we are in a position to ask those involved to share their insights.
First up, to provide legal insights and to summarise the business implications that resulted, we are delighted to be joined by two of New Zealand's leading specialist health and safety lawyers:
Grant and Garth will be sharing their reflections on this significant case and discussing implications for businesses going forward. There will be an opportunity for attendees to put their questions to Grant and Garth in the Q&A session at the end.
On 29 May Dr Chris Peace, who was called by the WorkSafe prosecution to act as an expert witness, will be following up with his own insights and 'take homes' from the case.
Grant Nicholson
Widely regarded as one of New Zealand’s leading health and safety lawyers, Grant has extensive experience in all aspects of health and safety law. Garth Gallaway
One of New Zealand’s leading legal experts in H&S, Garth acts for employers in investigations and prosecutions, both on direct instructions and through insurers. He has been involved in some of New Zealand’s highest profile coronial inquests, and provides strategic legal advice to leading corporates and boards on H&S matters.
Garth has extensive experience advising clients on professional indemnity, statutory liability and public liability insurance. He has a broad civil litigation practice and has appeared before all levels of the court system and numerous specialist tribunals. He frequently acts for solicitors, accountants, real estate agents, valuers and a range of organisations in professional negligence proceedings and disciplinary matters. He is also experienced in alternative dispute resolution, especially mediation.
